Terms and conditions for rental of 7432 Gathering Court, Reunion, FL 34747
1. General
1.1 The booking contract is between the hirer and the owner of the property for which the booking is made and incorporates the conditions set out below. The price includes reasonable use of utilities but NOT pool/spa heating, flights, car hire, holiday insurance etc.
2. Authority to sign
2.1 The person who signs the booking form certifies that he or she is authorized to agree to Booking Conditions on behalf of all persons included on the Booking Form. The signatory must be a member of the party occupying the property and must be 21 years or over.
3. Booking procedure, payment terms and remittance
3.1 Guests should contact the owners to check availability and price. A booking will only be considered firm when the non-refundable reservation deposit of 25% and booking form have been received and when the booking has been confirmed.
3.2 The balance of payment (75%) must be received 8 weeks before the date of arrival at the property.
3.3 Bookings made within 8 weeks of arrival are payable in full at the time of booking.
3.4 If you wish to use the facilities of the Reunion Resort this is possible using a guest card system. We will arrange for guests cards to be made available at a cost of $50.00
3.5 All payments (unless other special arrangements are made) are handled through PayPal. PayPal accepts payment by credit card, debit card or bank draft. Once you paid non-refundable reservation deposit by clicking on the "BUY NOW" symbol we confirm your reservation. You do not need to be a member of the PayPal network to take advantage of this free, secure and convenient service.
4. Booking cancellations
4.1 Bookings may be cancelled at any time subject to cancellation charges.
4.2 Cancellation must be made in writing by the party leader.
4.3 In the event of cancellation, the following charges apply: 8 weeks or more prior to rental period - loss of deposit only, less than 8 weeks - 100% rental charge. For most reasons beyond your control cancellations will be covered by your travel insurance. We advise you to take out adequate travel insurance for all members of your party.
4.4 The owners reserve the right to cancel the booking if the payments are not received by the due date.
4.5 The owner reserves the right without notice to transfer the guest to other accommodation of identical conditions if available. Should the owner not be able to supply such accommodation then a full refund will be offered.
4.6 In the unlikely event of cancellation by the owners, the owners will fully refund any monies paid as soon as reasonably practical.
5. Refundable deposits
5.1 Upon signing the rental agreement the signatory agrees to pay for any damage of any kind to the property from the security deposit including but not restricted to breakages or damage to the premises and or contents and excessive cleaning costs other than those normally incurred in connection with the occupation of the premises. A refundable security deposit of $1000 must be paid along with the final balance by you regardless of the length of stay. The deposit will be refunded within 4 weeks of vacating the property, subject to deductions to cover the expenses mentioned above.
5.2 Reunion Resort is a cashless resort. All expenses (e.g. golf, tennis, horse riding, restaurant, massage therapy, etc.) will billed through the provided guest card (see 3.4). Since the billed account is owned by the villa owner we ask for a refundable resort expense deposit of $750,=. The deposit will be refunded within 4 weeks of vacating the property, subject to deductions to cover the expenses mentioned above.
6. Arrivals and departures
6.1 The house will be available for occupancy from 4:00pm on the day of arrival and must be vacated by 10:00am on day of departure.
7. Accommodation
7.1 Sub-letting, sharing or assigning is strictly prohibited.
7.2 Everyone occupying the house, including ages, must be listed on the booking form, including small children.
7.3 The maximum number of guests is 8 persons (excluding small children). All persons must sleep in the bedrooms/beds provided. Additional cots can be arranged.
7.4 Persons under 25 years of age are not acceptable unless accompanied by parents or responsible adults.
8. Smoking
8.1 For the comfort and safety of guests, smoking is strictly prohibited within the property.
9. Animals and pets
9.1 Animals and pets are not permitted in the property. For the comfort and safety of guests.
9.2 If a pet has been in the property, there will be an automatic charge at the owner's discretion to cover the cost of professionally cleaning all carpets and upholstery and to call in a pest control agency.
10. Insects and pests
10.1 Insects and pests are inevitably present in the Florida climate. The property receives periodic pest control treatment, but occasionally pests will find their way into the property. They are best eradicated by spraying with an appropriate product.
11. Cleaning
11.1 Price includes one clean before arrival.
11.2 Cleaning after departure will be charged separately.
11.3 Although the property will be cleaned after departure, it must still be left in an orderly state. Should the property require extensive cleaning then the owners or their agents reserve the right to withhold any monies from the security deposit to pay for extra cleaning.
11.4 Should you require a weekly or daily clean, this must be requested at the time of booking and will be subject to additional charges.
12. Purchase of pool heat
12.1 Pool heating should be requested at the time of booking (recommended November-March). There is an additional charge and this must be paid for within the final balance. Please see the rental rates for pool heat charges.
12.2 In the event pool heating is requested and paid for, the owners cannot guarantee the temperature of the pool as this will vary according to different factors, predominantly the weather conditions at the time.
12.3 The owner or owner's agent will not be held responsible for any electrical or mechanical failure of pool heating equipment. In this event a full refund of the pool heat charge will be administered.
13. Responsibilities
13.1 The guests are responsible for the property, and are expected to take all reasonable care of it including the locking of all doors and windows and ensuring the security alarm is activated whenever the house is unoccupied. At the end of the rental period, all equipment including everything in the house, all walls, carpets and furnishings must be left clean and tidy.
13.2 Guests are expected to clean the outside kitchen (grill plates) after each use.
13.3 Use of swimming pool
- Use appropriate swim nappy/diaper for children who are not fully toilet trained
- For your own safety, glass or bottles are not allowed in the pool area or spa
- No bubble or similar liquids to be used in the pool or spa
13.4 When doors/windows are left open you will be notified by a delayed alarm sound to indicate the open door/window should be closed. This will help to keep the air conditioning costs to a reasonable level. It will also prevent insects and other animals (e.g. lizards) entering the house.
14. Loss and damage
14.1 Any loss or damage caused during your stay must be reported immediately to the owners or their agent.
14.2 The lead renter must make good or pay for any loss, damage or breakage.
14.3 The owners reserve the right to withhold any monies from the security deposit to pay for any loss or damage caused to the property or its contents by any member of the party.
14.4 Any loss or damage caused by guests costing more than the security deposit will be fully reimbursed by the lead renter within 1 week (7 days) of departure.
15. Liability
15.1 The owners and Agent/Management Company of the property accept no responsibility whatsoever for the death, personal injury, accidents, loss, or damage to persons or personal belongings however caused.
15.2 The use of all accommodations and all amenities, including the swimming pool is entirely at the users own risk. Children must at all times be supervised by responsible adults when using the swimming pool and at no time at all are the pool and deck doors' alarms to be tampered with. Glass is not permitted within the pool area.
15.3 The owners and Agent/Management Company cannot accept any liability for any loss or damage or alteration, delay or changes to rental time arising from circumstances outside our control such as war or threat of war, fire, or adverse weather conditions, government actions, terrorist acts, industrial disputes or any events, closure, travel problems, flight delays, congestion at airports, cancellation or changes of schedules by airlines, theft from the premises (both interior and exterior including garage, pool and spa areas), including any form of Force Majeure.
16. Force Majeure
16.1 As with any other holiday, there may be circumstances completely beyond our control and contemplation, in which the property might not be available for your booking. Examples of these circumstances include (but are not limited to) destruction of or severe damage to the property. Such circumstances are referred to as "Force Majeure". In the event of Force Majeure the owners will do their best to make alternative arrangements for you where possible. If they cannot, or if alternative arrangements are unacceptable to you, then they will refund all monies paid. This will be the full extent of the owner's liability to you in such circumstances, and they shall not be responsible for any other costs connected with any such cancellation, however arising.
17. Code of conduct
17.1 All clients undertake to behave with propriety and in such a manner as in no way to cause or be likely to cause damage, distress, danger or annoyance to neighbours, other clients, property and/or any third party. The contract of any client in breach of this clause will be terminated and neither we nor the providers of the services in question will have any further contractual obligations to you.
18. Owners access
18.1 The owners or their Agent/Management Company shall be allowed access at any reasonable time during your stay. You will be notified prior to any visit.
19. Complaints
13.1 In the unlikely event that the guest has any reason for complaint or dissatisfaction, they must contact our property management (Norma at 407 346 3292 or Sean at 407 346 1280), so that speedy and remedial action can be taken.
20. Law
20.1 This contract is subject to and shall be construed in accordance with the laws of Great Britain and all parties hereby submit to the exclusive jurisdiction of the British Courts.
